The following terms and conditions constitute an agreement between you and Front Door Health, LLC (“FDH”). Your use of this website indicates your acceptance of these terms and conditions and agreement to be bound by them. FDH has the right to modify these terms and conditions without prior notice and will inform you of any and all modifications by posting same in this location. You agree to accept and be bound by any modified terms and conditions through your subsequent and continued use of FDH’s website.

FDH’s website is offered “as is,” for informational purposes only, without warranty of any kind, either express or implied. While we strive to provide accurate and helpful content, we do not warrant or represent that the content provided is in fact accurate, available or useful for any particular purpose. You acknowledge that such content and information may contain inaccuracies and we expressly exclude and limit liability for any such inaccuracies to the fullest extent permitted by law.

Confidential and Proprietary Information

FDH is the exclusive owner of this website and all of its content. All material contained on the website, including without limitation all software, HTML code, logo, design, URL, charts, taglines, graphs, photos and other code, is protected by United States and foreign copyright laws. Absent FDH’s express and written permission, you may not copy, distribute, display, transmit, reproduce, publish or otherwise use in any way the content, structure and design of this website. Failure to abide by this admonition may subject you to civil and criminal penalties.

Nature of Services

All services are provided by licensed physicians and other behavioral health professionals under the direction of Front Door Health Medical OR Jonathan Adelstein MD, PLLC. FDH is an administrative and technology service provider designed to facilitate the provision of behavioral healthcare treatment services, including principally services delivered in the care-recipient’s home. While FDH was created and is owned and operated by treatment professionals, including physicians, FDH does not provide medical services or medical advice. Rather, FDH has entered into contracts with certain independent health care professionals and physicians who provide medical and ancillary treatment services as they see fit (collectively, “Front Door Health Physicians”). Front Door Health Physicians is alone responsible for exercising control and supervision over the provision of all professional services and clinical decisions. Under no circumstance will FDH be responsible or liable for the provision of any professional services or exert any control or supervision over any provision of professional services or make any clinical decisions. Furthermore, nothing set forth within FDH’s website shall be construed as medical advice and is instead offered for informational purposes only and contains no implied or express warranties as to accuracy of the information provided or suitability for any particular person or situation. The decision to initiate and define scope of treatment services rests exclusively with Front Door Health Physicia

User Privacy and Confidentiality

As set forth separately in FDH’s Privacy Policy, which is incorporated herein by reference, FDH’s website collects certain technical information including user’s name, if shared, email address, if shared, IP address and unique device identifiers. Additionally, we collect information regarding the user’s interaction with FDH’s website and any advertisements. FDH values your privacy and we take reasonable measures to protect your personal information from loss or misuse. If you have any questions or concerns related to what information we collect, how we use it, or if you believe your information is somehow vulnerable, please contact us at info@frontdoorhealthcenter.com.

Paying for Services

As the service provider, Front Door Health Physicians is solely responsible for billing patients for treatment services rendered by Front Door Health Physicians. 

Disclaimers and Limitation of Liability

FDH is not a provider of medical or other treatment services and is not liable for the acts or inaction of Front Door Health Physicians and/or Front Door Health Physician’s employees and/or contractors. Use of this website indicates that you expressly acknowledge and agree that FDH is not a provider of medical and treatment services and nothing contained herein shall be construed as medical advice. At-home treatment is a relatively new model of care and one FDH believes is designed to improve the consumer’s treatment experience and clinical outcomes; however, it is up to you to determine whether treatment at home is appropriate in your particular case. FDH does not and cannot guarantee treatment outcomes, only that you will receive evidence-based services delivered by qualified professionals. You hereby release FDH and Front Door Health Physicians from any liability for injuries, property loss or other damage arising out of the provision of services to the fullest extent permitted by law. 

Communications from FDH

User consents to communicating with FDH and Front Door Health Physicians through email, text, telehealth applications and telephone. User’s phone calls with us may be recorded and you hereby consent to that recording. These recordings are for internal training and process-improvement purposes and will not be shared with anyone outside FDH.

Prohibited Uses and Termination

Users of FDH’s website and services are prohibited from:

• leasing, selling, copying, sub-licensing, transferring, or assigning any information, intellectual property, goods, or services provided on the site
• using the site for any illegal purpose
• gaining unauthorized access to FDH’s data or the data of other users
• altering, modifying, adapting, reverse engineering, decompiling, disassembling, or hacking FDH’s intellectual property
• altering or modifying another website to falsely imply that it is associated with the FDH’s website,
• using or exporting FDH’s information, products, or services in violation of U.S. export laws and regulations
• violating anyone else’s legal rights (for example, privacy rights) or any laws (for example, copyright laws) in the user’s jurisdiction
• using FDH’s website or services to transmit content that could be deemed unlawful, threatening, harassing, racist, abusive, libelous, pornographic, vulgar, defamatory, obscene, indecent, or otherwise inappropriate, including any messages constituting or encouraging criminal conduct
• breaching, or attempting to breach, the website’s security systems
• enabling third parties to violate the Terms and Conditions of Use, and
• (if legally required) failing to ensure that all end users of the site are at least 18 years of age or older.

We reserve the right to terminate your account if you misuse FDH’s website or services, including without limitation the prohibited conduct identified immediately above.

Indemnification

You agree to defend, indemnify and to hold harmless, FDH and its officers and directors, from any and all liabilities, penalties, claims, causes of action, and demands brought by third parties arising, resulting from or relating to: (a) your use of FDH’s website or services; (b) an allegation that you violated any representation, warranty, covenant or condition of these Terms and Conditions; and/or (c) your intentional or negligent misrepresentation or misuse of confidential or protected information. Your agreement to indemnify FDH and its officers and directors shall survive your termination of or cessation of use of FDH’s website or services.

Governing Jurisdiction and Choice of Law

These Terms and Conditions of Use and user’s concomitant agreement to accept same shall be severable, and if any provisions thereof are found to be invalid or unenforceable, the remaining provisions shall remain unaffected and enforceable. User agrees that any and all claims related to these Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois. Any action brought against FDH, Front Door Health Physicians and/or their respective agents, employees, officers and affiliates, shall commence within the jurisdiction of Cook County, Illinois.

FDH’s Right of Assignment

FDH may assign its rights and obligations under these Terms and Conditions of Use and they shall inure to the benefit of FDH’s successors, assigns and licensees. User does not have this same right and may not assign her/his rights under this agreement.
